Naas Carley is a Shopify storefront operated by MONOLOGUE LLC. These Terms govern storefront access and purchases.

USING THE STOREFRONT

By browsing, creating an account, or submitting an order, the user agrees to these Terms and the policies referenced on the storefront.

Users must be legally capable of entering a binding agreement and must provide accurate information.

HOW AN ORDER BECOMES A SALE

Submitting an order is an offer to purchase.

An automated confirmation means that we received the request; it does not necessarily mean that we accepted it.

We accept an order when we issue a shipping confirmation or otherwise expressly confirm acceptance.

PRODUCT INFORMATION

We design product pages to explain the practical role of each outdoor item, including relevant dimensions, materials, capacity, compatibility, intended use, and care information.

Screens, lighting, manufacturing tolerances, and natural material variation can produce minor differences.

We will not substitute a materially different product merely because the ordered item is unavailable.

PRICING AND INVENTORY ERRORS

Prices and availability may change before acceptance.

If a price is clearly wrong because of a publishing or system error, we may cancel the affected item and refund any amount collected. We will not charge a corrected price without consent.

Inventory may change because of demand, product inspection, damage, or delayed system updates.

RESPONSIBLE OUTDOOR USE

Customers must read all supplied instructions and warnings, inspect equipment before every use, and stay within stated capacity and operating limits.

Outdoor equipment does not replace preparation, experience, weather awareness, emergency planning, or compliance with fire and land-use rules.

Unless expressly certified for such use, ordinary Naas Carley products must not be relied upon as climbing protection, fall arrest, professional rescue equipment, medical equipment, or life-support equipment.

ACCOUNT AND PAYMENT SECURITY

Users are responsible for protecting account credentials.

We may hold or cancel an order when payment cannot be verified or when activity reasonably appears unauthorized, fraudulent, abusive, or legally restricted.

PROHIBITED CONDUCT

Users may not:

• Commit fraud or impersonate another person
• Introduce harmful code
• Interfere with storefront operation
• Collect other users’ data without authorization
• Circumvent purchase or security limits
• Infringe intellectual-property rights
• Use the storefront for an unlawful purpose

INTELLECTUAL PROPERTY

The Naas Carley storefront’s original layout, written content, graphics, product presentation, and other creative materials are owned by or licensed to MONOLOGUE LLC.

They may not be commercially copied or redistributed without authorization.

SERVICE AVAILABILITY

The storefront may occasionally be unavailable for maintenance, provider interruptions, security work, or circumstances beyond our control.

We do not promise uninterrupted or error-free access.

LIABILITY

To the extent permitted by law, MONOLOGUE LLC is not liable for indirect, incidental, punitive, special, or consequential losses arising from storefront or product use.

Where legally permitted, aggregate contractual liability will not exceed the amount paid for the product giving rise to the claim.

Nothing here limits liability for fraud, willful misconduct, personal injury caused by negligence, or any matter that law does not allow us to limit.

GOVERNING LAW

These Terms are governed by Kentucky law and applicable United States federal law, without regard to conflict-of-law principles.

Courts with lawful jurisdiction in or serving Hardin County, Kentucky may hear disputes unless applicable consumer law provides another forum.

TIME STANDARD

All business days, deadlines, and notices use Eastern Time (“ET”), including EST or EDT according to the season.
